Scent Bytes LLC End User License Agreement (EULA)

1. Products Covered

This Agreement applies to all digital products sold under the Bytes’ Atelier brand, including but not limited to:

• Squarespace website templates

• Printable downloads

• Canva social media, marketing, and design templates

• AI image packs and other downloadable design assets

(each a "Product").

2. License Grant

Upon purchase, Bytes’ Atelier grants you a non‑exclusive, non‑transferable, revocable license to use the Product subject to the following conditions:

• You may use the Product for one (1) personal or business project owned by you or your direct client.

• You may customize the Product to suit your brand (for example, colors, fonts, copy, images).

• You may publish and display the Product publicly as part of your own website, brand, or social media presence.

All rights not expressly granted in this Agreement remain with Bytes’ Atelier.

3. Restrictions

You may not, under any circumstances:

• Resell, redistribute, share, gift, or transfer the Product or any portion of its design files (including templates, images, layouts, or copy) to any third party.

• Claim the Product or any derivative design as your own original creation.

• Use any Bytes’ Atelier Products as the basis for creating a competing template, theme, or digital design product for resale.

• Post or upload the Product or its components to any file‑sharing or cloud‑sharing platform accessible by others.

• Use AI image packs or templates in any way that violates the terms of the host platforms (for example, Canva, Squarespace, Google Drive).

If you purchased a Squarespace website template and Bytes’ Atelier completes a manual transfer, the license is granted to the transferee website owner only and cannot be reused or duplicated for other sites.

4. Ownership and Copyright

All Bytes’ Atelier Products and related materials are protected by international copyright law.

Copyright and all intellectual property rights remain the sole property of Bytes’ Atelier (Scent Bytes LLC).

Purchasing a Product does not transfer ownership. It grants a limited license to use the Product.

Bytes’ Atelier retains the right to display Product designs, layouts, or mockups for promotional and portfolio purposes.

5. Refunds

Due to the digital nature of our products, all sales are final. Refunds are not available once a Product or download link has been accessed, except where required under applicable consumer law.

6. Termination

Scent Bytes Studio reserves the right to revoke this license and deny access to future updates or support if you breach these terms.

In the event of termination, you must immediately cease use of the Product and remove all copies from your devices and platforms.

7. Limitation of Liability

Bytes’ Atelier is not liable for any loss of revenue, data, or business arising from the use or inability to use a Product.

All Products are provided "as is" without warranties of any kind, express or implied.

8. Transfer Policy (Squarespace Templates)

Manual website transfers are performed one time only, for the purchaser or their nominated client.

Subsequent reuse, duplication, or resale of the template structure is strictly prohibited without written permission from Scent Bytes Studio.

9. Updates and Modifications

Bytes’ Atelier may update or modify Products periodically. Updates are made available at our discretion and do not grant new rights or additional licenses beyond your original purchase.

10. Governing Law

This Agreement is governed by the laws of the state of Georgia, USA, and both parties submit to the non‑exclusive jurisdiction of its courts.

12. Brand Names and Attribution Restrictions

Each Bytes’ Atelier template or product suite includes proprietary branding and a distinctive name.

You agree not to use, display, or reference these brand names, logos, or associated visual identities in connection with your own website, marketing materials, or business name.

Specifically, you may not:

• Present your finished site or materials as "built with Bytes’ Atelier," "SBS template," or similar phrasing.

• Use any Bytes’ Atelier template name, sub‑brand, or logo styling as part of your own business name, domain, or marketing identity.

• Combine the template’s name with its visual identity (such as the included color palette and typography) in a way that suggests your brand is, or is affiliated with, the original Scent Bytes Studio design concept.

You may freely use and customize the color palette, typography, and design elements included with your purchased template to build your own brand identity, provided you do not use the original template name in conjunction with those visuals.

All template names and brand marks remain the intellectual property of Scent Bytes Studio and are protected under applicable copyright, passing‑off, and consumer‑law principles.

Unauthorized use, copying, resale, or misrepresentation of Bytes’ Atelier products or brand names constitutes a violation of copyright and trademark law and will be pursued accordingly.
